PLEASE READ THESE TERMS & CONDITIONS (“TERMS”) CAREFULLY. These Terms govern your access to and use of https://akahomesafety.com(the “Site”) and any home safety evaluation, quote, installation, home modification, or related services provided under the AK@HOME brand (the “Services”). By using the Site, booking Services, purchasing Services, or submitting payment, you agree to these Terms without modification. If you do not agree, do not use the Site or Services.

AK@HOME operates from Nevada, does business in California, and may expand nationally.
1) Our Services
AK@HOME provides home safety evaluations, recommendations, and home modification solutions intended to improve safety and accessibility.
No guarantee of results: Evaluations and modifications may reduce risk but cannot eliminate the risk of falls, injury, property damage, or other harm.
2) Independent Locations (National Expansion / Franchising)
AK@HOME may provide Services through company-owned operations and may also provide Services (now or in the future) through independently owned and operated locations, independent contractors, and/or franchisees (“Local Providers”).
Unless expressly stated in a written agreement signed by AK@HOME Safety, Local Providers are independent businesses and are solely responsible for their services, personnel, licensing, insurance, permits, workmanship, pricing (where permitted), and compliance with applicable laws. Local Providers are not agents or employees of AK@HOME Safety.
3) Third-Party Providers; Additional Work; Approval Required
AK@HOME may use third-party companies, subcontractors, installers, and other service providers (“Third-Party Providers”) to perform some or all of the improvement work in your home. Third-Party Providers are independent entities and are responsible for their own workmanship, employees, licensing, insurance, permits, and compliance with applicable laws, unless otherwise stated in a written agreement signed by AK@HOME Safety.
During an evaluation or while performing work, additional items may be identified that should be repaired, replaced, renewed, or upgraded to help make the home safer and easier to use (for example, materials behind walls, worn components, water damage, or outdated/unsafe fixtures). These items may result in additional costs beyond the original scope.
Any such additional work and related costs will be presented to you as a written quote and/or change order by AK@HOME and/or a Third-Party Provider, and will be performed only after you (the consumer) approve it. If you do not approve the additional work, AK@HOME may be unable to complete certain improvements safely or as originally planned, and the project scope may be modified accordingly.
4) Eligibility and Authority
You must be at least 18 years old (or age of majority where you live) to book Services or make purchases. You represent that you have authority to request Services at the property (as owner or authorized representative).
5) No Professional Advice
Information and recommendations provided through the Site or Services are for general informational purposes only and are notmedical, legal, architectural, engineering, or other professional advice. Consult qualified licensed professionals as appropriate.
6) AI-Generated Inspection Questions (In-House)
AI-Assisted Tools. AK@HOME may use internally developed software tools, including artificial intelligence (“AI”), to help generate or organize inspection questions, notes, and recommendations as part of our evaluation process. AI outputs are used to support human judgment and are not a substitute for on-site observation, professional expertise, or your own decision-making.
No Reliance; No Guarantee of Accuracy. AI-generated questions or recommendations may be incomplete, inaccurate, or not appropriate for your specific home, conditions, or needs. You agree not to rely solely on AI-generated output. Final recommendations and next steps depend on the conditions observed, information available at the time of evaluation, and the details you provide.
Not Professional Advice. AI-assisted content is not medical, legal, architectural, engineering, or safety certification advice.
Data Handling (In-House). AK@HOME’s AI tools are developed and operated internally. We use evaluation details to generate your report and recommendations and take reasonable steps to minimize the use of personal information where not necessary.
Limitation of Liability for AI Tools. To the fullest extent permitted by law, AK@HOME disclaims liability for errors or omissions arising from AI-assisted content. This does not limit liability for gross negligence or willful misconduct where such limitation is not permitted by law.
7) Payments; Online Payments via Stripe
We accept online payments for evaluations and solutions. Payments are processed by third-party processors (e.g., Stripe). We do not store full payment card numbers.
By submitting payment, you authorize charges consistent with your approved scope, deposit(s), milestones (if applicable), and final invoice.
8) Cancellation / Rescheduling (Evaluations)
9) Evaluation Fee Credit Toward Project Work
If you proceed with approved project work, your evaluation fee will be credited toward the project cost as reflected in your proposal or invoice, unless stated otherwise in writing.
10) Quotes, Scope Changes, and Change Orders
Any quote or estimate is based on conditions reasonably observable at the time and information you provide. Pricing and timelines may change due to scope changes, hidden conditions, code/permit requirements, or materials availability/pricing changes.
Any work outside the agreed scope requires written authorization (a “Change Order”) before it is performed.
11) Access, Safety, and Site Conditions
You agree to provide reasonable access to the property at the scheduled time, secure pets, and maintain a safe work area.
We may refuse, pause, or stop Services if conditions are unsafe, access is not provided, required utilities are unavailable, or concealed hazardous conditions are discovered. You remain responsible for Services performed and costs incurred up to the stop point, to the fullest extent permitted by law.
12) Completion; Customer Acceptance
Upon completion, you agree to inspect the work and either accept it or provide written notice of any material issues within 48 hours. If you do not provide written notice within 48 hours, the work will be deemed accepted, subject to any nonwaivable rights under applicable law.
13) No Warranty
No Express Warranty. To the fullest extent permitted by law, AK@HOME provides the Site and Services without any express warranties. Statements, examples, and recommendations do not create a warranty or guarantee.
Implied Warranties. Some states do not allow limitations on implied warranties. To the fullest extent permitted by law, we disclaim implied warranties (including merchantability and fitness for a particular purpose). Where disclaimers are not allowed, implied warranties are limited to the shortest period permitted by law.
Manufacturer Warranties. Any product or material warranties are provided solely by the manufacturer, not AK@HOME, unless stated otherwise in writing.
14) No Reliance; No Oral Modifications
You agree you are not relying on statements not expressly included in the written scope, change orders, proposal, and paid invoice. No oral advice or written information outside of those documents modifies these Terms.
15) Disclaimers and Limitation of Liability
YOUR USE OF THE SITE AND SERVICES IS AT YOUR SOLE RISK.The Site and any Site-related services are provided “AS IS,” “WITH ALL FAULTS,” and “AS AVAILABLE,” without warranties of any kind, to the fullest extent permitted by law.
To the fullest extent permitted by law:
Some jurisdictions do not allow certain limitations; in those jurisdictions, limitations apply to the fullest extent permitted.
16) Assumption of Risk
You acknowledge that home safety improvements reduce risk but cannot prevent all accidents. You assume risks associated with use of the property and installed products, except to the extent caused by AK@HOME’s gross negligence or willful misconduct.
17) Notice and Opportunity to Cure
Before filing any claim, you agree to provide written notice describing the issue and allow us 30 days to inspect and, at our option, attempt to remedy the issue. This does not limit rights that cannot be waived under applicable law.
18) Acceptable Use of the Site
You may not misuse the Site, attempt unauthorized access, introduce malware, scrape/copy content without permission, or use the Site for unlawful purposes. We may restrict access for violations.
19) Third-Party Content and Links
The Site may contain third-party content or links. AK@HOME does not control and is not responsible for third-party content, websites, or services. A link does not imply endorsement.
20) Intellectual Property + Trademark
All Site content is owned by or licensed to AK@HOME and protected by law.
AK@HOME® is trademarked and registered. AK@HOME®, the AK@HOME Safety name, logo, and related marks are registered trademarks of AK@HOME Safety. All rights reserved.
All other trademarks belong to their respective owners.
21) Force Majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control (weather, disasters, supply chain disruptions, labor shortages, government actions, utility outages).
22) Indemnification
You agree to defend, indemnify, and hold harmless AK@HOME from claims arising from your breach of these Terms, misuse of the Site, or unlawful conduct.
23) Arbitration Agreement; Class Action Waiver; Opt-Out
PLEASE READ THIS SECTION CAREFULLY. It affects your rights.
23.1 Agreement to Arbitrate
Except for (a) claims that may be brought in small claims court, and (b) claims seeking injunctive or other equitable relief for alleged unlawful use of intellectual property, you and AK@HOME agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services (each, a “Dispute”) will be resolved by binding individual arbitration and not in court.
23.2 Arbitration Administrator and Rules
Arbitration will be administered by JAMS under its applicable rules in effect when arbitration is initiated, except as modified by these Terms. The arbitrator may award any relief available in court on an individual basis.
23.3 Location and Fees
Unless otherwise required by law, the arbitration will take place in Clark County, Nevada, or another location agreed by the parties (or by video conference). Payment of arbitration fees will be governed by JAMS rules and applicable law.
23.4 Class Action Waiver
You and AK@HOME agree that Disputes must be brought in an individualcapacity only and not as a plaintiff or class member in any purported class, collective, private attorney general, or representative proceeding, to the fullest extent permitted by law.
23.5 Opt-Out Right
You may opt out of this Arbitration Agreement within 30 days of the date you first accept these Terms by emailing [Email Address] with:
If you opt out, neither you nor AK@HOME can require the other to participate in arbitration.
23.6 Severability
If any part of this Arbitration Agreement is found unenforceable, the remainder will be enforced to the fullest extent permitted by law. If the Class Action Waiver is found unenforceable, the Arbitration Agreement will be enforced to the extent permitted by law.
24) Governing Law; Venue (If Arbitration Doesn’t Apply)
These Terms are governed by Nevada law, except where the law of the state where Services are performed must apply.
If arbitration does not apply, Disputes relating to Services must be brought in the courts located in the county/state where Services were performed, and Disputes relating solely to Site use may be brought in Clark County, Nevada, to the fullest extent permitted by law.
25) Changes to These Terms
We may revise these Terms at any time by posting updated Terms on the Site and updating the Effective Date. Continued use of the Site or Services means you accept the updated Terms.
